San Marcos’ single-use beverage container ordinance gets green light

“By encouraging residents and visitors to bring reusable beverage containers—I think naturally we’re going to see a lot less trash in our waterways,” Parker said.

Kyle officials to study future water supply As the city continues to grow, Kyle City Council is looking to begin building a plan to address short-term and long-term water supply issues with a Water Master Plan. The city’s long-term water plan is for 50 years of future water needs. Its short-term plan looks to address water supply issues through 2028. Council approved a $496,783 task order to structural engineering firm CP&Y to develop its Water Master Plan on Feb. 20. How we got here Like many cities in the Central Texas region, a prolonged drought has put a strain on the city’s water supply. In September, San Marcos City Council unanimously approved an interlocal water agreement allowing them to temporarily transfer Edwards Aquifer Water rights to the city of Kyle. The city of Kyle also implemented amended Stage 3 restrictions with the goal of reducing the city’s water usage by 30%.

Deal to open a Buc-ee’s in San Marcos approved Buc-ee’s is one step closer to opening a San Mar- cos location, bringing at least 175 jobs. San Marcos City Council approved a Chapter 380 tax incentive agreement with Buc-ee’s on March 5. By the numbers

travel center located along I-35, south of Yarrington Road. The travel center would also be equipped with 120 fueling stations and space for electric vehicle charging. According to agenda documents, plans for the travel center include bringing 200-225 more jobs to the area, and the company would donate $100,000 to the city’s community fund. Stan Beard, Buc-ee’s director of real estate and development, said the council’s initial approval was a big step forward and that they were excited. “We think we’re [going to] be a big plus for the community. We can’t wait to get started,” Beard said. City seeks investment in low income housing Riverview Apartments in the Blanco Gardens neighborhood might be getting a makeover. San Marcos City Council approved a resolution supporting the submission of an application for Low Income Housing Tax Credits to the Texas Department of Housing and Community Affairs for Riverview Apartments on Feb. 20. LIHTCs are meant to provide an equitable financing source that developers can use to create affordable rental housing for low-income house- holds, according to the Texas State Affordable Housing Corporation website. The Workforce Housing City Council Committee recommended approval of the request on Feb. 13, according to agenda documents. About the project The property is located at 601 River Road in San Marcos and consists of 54 housing units—40 of

Incentive agreement for HTeaO approved HTeaO is bringing its flavored teas to Kyle. Kyle City Council approved a Chapter 380 First Year on Us incentive agreement in an amount not to exceed $10,000 on Feb. 6. According to the city’s economic devel- opment website, the First Year on Us is a commercial development plan that allows owner-occupied businesses to apply for a one-time tax rebate of up to $10,000 for property improvements.

Hernandez said the request was for a 9% Competitive Housing Tax Credit, most of which are awarded to the city of Austin. The 9% tax credit will provide assistance to rehabilitate the property. The resolution of support will also give the applicant additional points on their application from the state.

Hays CISD board approves 4 new hires The Hays CISD board of trustees unanimously approved three new district hires during its regular meeting Jan. 22. On Feb. 26, the board also approved a new band director for Johnson High School. The details Ralph Puger Elementary School Principal Eliz- abeth Lara will become the rst principal of Jim Cullen Elementary School, which is set to open in August for the 2024-25 school year. Superintendent Eric Wright said Lara stood out as a candidate for her experience in teaching at an International Baccalaureate campus, which will be piloted at Cullen Elementary and other campuses. Mark Torres will become the athletic coordina- tor and head football coach for Hays High School. Alan Duerr, HCISD deputy chief technology o- cer, has been promoted to chief technology ocer.

Texas State purchases apartments for student use Texas State University has purchased two apart- ment buildings in downtown San Marcos to house an additional 1,086 students.

The big picture Mattera said that the growth of the freshman class over the past few years has caused a short- age in campus housing. “Rents have increased by 40% in the San Mar- cos market, [Texas State] has increased by 11%,” Mattera said. “And so it’s an opportunity to set up some aordable housing close to campus.”

The Vistas and Sanctuary Lofts were acquired by Texas State in December. The $151 million purchase of the two properties was cheaper per-square-foot than building new dormitories, according to Bill Mattera, executive director of housing and residential life at Texas State.

The Texas Department of Transportation recently held a virtual open house to gather community input on future improvements to I-35 between Austin and San Antonio. The gist A Planning and Environmental Linkage study is evaluating potential improvements along I-35 from SH 45 near Buda to Cibolo Valley Drive, according to a news release. The study will focus on how to best connect the I-35 Capital Express South project in Travis County to the I-35 Northeast Expansion project in Guadalupe County and identify projects that can be developed in the future. Three in-person open houses on the study were hosted by TxDOT in Buda, New Braunfels and San Marcos. According to TxDOT, the purpose is “to Future I-35 work discussions begin

explore transportation alternatives to address the growing safety, mobility and connectivity needs along the corridor due to the projected population and employment growth in the region.” The backstory At a recent transportation summit held by regional and state leaders in San Marcos on Feb. 20, Marc Williams, the executive director of TxDOT, said the state is seeing about 1,300 people move in every day, and a significant number of that total chooses the Austin-San Antonio corridor. “The work will never conclude on Interstate 35 between Austin and San Antonio. I can say that pretty, pretty definitively, and I think I’ve heard some groans in the room when I say that,” Williams said. “The Texas Department of Transportation [will] work with partners like these metropolitan planning organizations ... along with local level folks of the counties and the cities to understand your needs, and to help effectively address those.” Information regarding the study presentations and how to leave a comment is available at www.txdot.gov and search for “I-35 link study.”

An apartment complex named Flatz 512, located at 834 Cottonwood Parkway in San Marcos, is almost complete. The project broke ground in 2020 and is expected to be completed in August, according to an email from Assistant Manager Amanda Benavidez. Beverage containers not allowed: These are examples of single-use beverage containers allowed and not allowed on the San Marcos River and adjacent city parks.

Case said the city currently uses a “three-prong” approach when it comes to abating litter. The rst is through “litter boats”—small vessels maintained by the Habitat Conservation Team—which is funded by the city and Texas State University as part of the Edwards Aquifer Conser- vation Plan. The second is city park personnel that educate patrons on park rules and to pick up litter. The third is a contractor that works weekends, holidays and summers to ll the gap when parks maintenance and ambassadors leave for the day. Case said that crews maintaining the litter boats were struggling with litter volume. “Our parks are so popular that we have a very hard time keeping up with any kind of abatement eorts,” she said. The city of San Marcos has two part-time park rangers and 11 deputy marshals. On Feb. 7, the city analyzed park personnel costs, but due to budgetary constraints, the city did not have the ability to hire additional deputy marshals or park personnel.

“We’re excited to be able to launch this campaign and protect our river, and make the experience of going to the river even better than what it already is,” she said. The education period will begin on May 1 and end on April 30, 2025. During this time, the city will focus on outreach strategies that educate residents and tourists on ordinance rules, boundaries and awareness through extra signage and utility billing inserts.

Lauren Surley, director of communications and intergovernmental relations, said the communications department will reach out to nonprots along with other community leaders in San Marcos and surrounding areas within a 50- mile radius of the city to spread the message. Surley said the department will launch its rst outreach campaign May 1—the day the ordinance goes into eect.

“It’s going to come down to directional signage and delineations along our pathways,” Case said. In 2011, the city of New Braunfels passed a similar ordinance on rivers within the city’s limits. That ordinance was met with controversy and brought to the Texas Supreme Court before being reinstated in 2018, according to previous reporting by Community Impact . The San Marcos ordinance focuses primarily on single-use beverage containers, whereas the New Braunfels ordinance focuses on disposable food and beverage containers. Case said the decision to focus on single-use beverage containers was to alleviate “undue stress” for families that would have to gure out a way to be compliant with birthday cake containers or juice boxes. Tom Goynes, former president of the Texas Rivers Protection Association, said the organization had been “begging” the city to pass this kind of ordinance since New Braunfels passed theirs.

The ordinance identies two types of areas known as “Go Zones” —areas where single-use beverage containers are allowed—or "No Zones"where only reusable beverage containers are allowed—along the river and in city parks adjacent to the river. There are ve areas—“Go Zones”— that will remain unaected by the ordinance: Children’s Park, City Park, Plaza Park, Ramon Lucio Park and Rio Vista. The following parks designated as “No Zones” are as follows: Bicentennial Park, Cape’s Dam, Hays County Veterans Memorial. Stokes Park. Thompson Island Dam, Veramendi Park, Wildlife Park and William & Eleanor Crook Park. Jamie Lee Case, director of parks and recreation, explained that there is no quantiable distance for residents to know when the ordinance is in eect since their riverbanks vary in distance. The "No Zones" will have signage reminding individuals when the ordinance is in eect, which is primarily along the riverbanks.
